Terms of Service

By downloading, installing, or using the PozeQuest mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Changes take effect when we post the updated Terms and update the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

You must be at least 13 years of age to use PozeQuest. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent to use the Service.

You must provide accurate and complete information when creating your account and keep this information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise harm the Service or our community.

Your content: You retain ownership of photos, poses, and other content you submit to PozeQuest ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, distribute, and adapt your User Content solely for the purposes of operating and improving the Service.

Content standards: You agree not to submit content that:

• Is unlawful, obscene, defamatory, threatening, or harassing
• Infringes any third party's intellectual property or privacy rights
• Contains nudity, sexual content, or graphic violence
• Impersonates any person or entity
• Contains malware, spam, or unsolicited commercial content
• Depicts dangerous or illegal activities

We reserve the right to remove any User Content that violates these standards without prior notice.

PozeQuest offers free access with optional premium features available via in-app purchase, including lifetime access plans and Pro subscriptions. All purchases are processed through the Apple App Store and managed by RevenueCat.

Refunds: All purchases are subject to the refund policy of the platform through which you purchased (Apple App Store). We do not control Apple's refund decisions. To request a refund, contact Apple directly through your App Store purchase history.

Price changes: We reserve the right to change subscription prices with reasonable notice. Existing subscribers will be notified before any price change takes effect.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of PozeQuest and its licensors. Our trademarks, logos, and service marks may not be used without our prior written consent.

The pose guides, location data, challenge structures, and AI coaching system in PozeQuest are protected by copyright and other intellectual property laws.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Reverse engineer, decompile, or disassemble the Service
• Scrape, crawl, or otherwise extract data from the Service in an automated manner
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts for the purpose of evading bans or restrictions
• Harass, bully, or harm other users of the Service
• Use the Service to distribute spam or unsolicited promotional material

The Service integrates with third-party services including Google (authentication), Apple App Store (purchases), and RevenueCat (subscription management). Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Pose suggestions are provided for entertainment and creative inspiration; we are not responsible for any injury or harm resulting from attempting poses at any location.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POZEQUEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or, where arbitration is not available, in the courts of Vietnam.
